1. About this policy
VIPER Metrics Pty Ltd (“VIPER Metrics”, “we”, “us” or “our”) is based in Perth, Western Australia. We provide asset management software for the mining and resources sector.
This policy explains how we collect, hold, use and disclose personal information when you visit vipermetrics.com, contact us, or sign in to our platform at app.vipermetrics.com (together, our “Services”). It also explains your choices and how to contact us.
We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Our customers and website visitors are in Australia and overseas, so this policy also explains what happens when personal information crosses borders (see section 12).
If a customer uses our platform to store information about its own staff, assets or operations, we handle that information on the customer’s behalf under our agreement with them. The customer is responsible for how it collects and uses that information, and you should read the customer’s own privacy policy.
2. The personal information we collect
The kinds of personal information we collect depend on how you deal with us.
Information you give us
- Your name, business email address, phone number, company and job title, when you complete a form, request a demonstration, or contact us.
- The content of your messages and any details you choose to include.
- Account details for people who use our platform, such as name, business email address, role and sign-in credentials.
- Business contact and billing details for customers and prospective customers.
- Your marketing preferences, including if you ask us to stop contacting you.
Information collected automatically
- Your IP address, browser type, device type, operating system and language settings.
- The pages you view, the links you click, how long you stay, and the website you came from.
- Approximate location, worked out from your IP address.
- How you interact with a page, such as clicks, scrolling and mouse movement, which may be captured in session recordings (see our Cookie Policy).
Information from other sources
- Details about staff and users that our customers give us so they can use the platform.
- Information from the service providers that help us run analytics, forms and lead handling.
Sensitive information
We do not ask for sensitive information (for example health, racial or ethnic origin, political or religious beliefs, or criminal record information) through our website. Please do not include it in messages or forms. If you do, we will only handle it as needed to respond to you and as the law permits.
Children
Our Services are for businesses. We do not knowingly collect personal information from children.
3. How we collect personal information
We collect personal information:
- directly from you, when you use our forms, email us, call us, request a demonstration or sign in to the platform;
- automatically, through cookies, pixels, tags and similar technologies when you use our website;
- from our customers, when they add their staff or users to the platform; and
- from our service providers, when they give us information about how our website is used.
4. Why we collect, use and disclose personal information
We collect, use and disclose personal information to:
- respond to enquiries, provide demonstrations and prepare quotes;
- create and manage platform accounts, provide and support the platform, and keep it secure;
- manage our relationships with customers and prospective customers, including billing;
- understand how our website is used, fix problems and improve our Services;
- promote our Services and measure how well our marketing works;
- detect and prevent fraud, misuse and security incidents; and
- meet our legal and regulatory obligations and protect our legal rights.
We only use or disclose personal information for the purpose we collected it, for a related purpose you would reasonably expect, with your consent, or where the law requires or permits it.
5. Direct marketing
We may send business updates and offers to people who have asked for them or who would reasonably expect to hear from us. We comply with the Spam Act 2003 (Cth) and applicable marketing laws. Every marketing message includes a way to unsubscribe, and we act on unsubscribe requests within five business days. You can also opt out at any time by emailing us.
We do not sell personal information.
6. Who we share personal information with
We share personal information with service providers who help us run our business. They may only use it to provide services to us. These include:
- Website hosting and forms: Webflow.
- Lead handling and customer relationship management: Typeform, Zapier and monday.com.
- Analytics and measurement: Google (Google Analytics, Google Tag Manager and Google Search Console), Microsoft (Clarity), Ahrefs and LinkedIn (LinkedIn Insight Tag).
- Professional and business support: accountants, lawyers, insurers, and IT and security providers.
We may also disclose personal information to government agencies, regulators or courts where the law requires or permits it, and to a buyer or successor if our business or assets are sold or restructured.
7. Cookies and similar technologies
Our website uses cookies, pixels and tags for analytics and measurement. Our Cookie Policy names each provider, explains what they do, and explains how to opt out. It forms part of this policy.
8. Automated decisions
We do not use automated decision-making on our website that significantly affects the rights or interests of individuals. If that changes, we will update this policy.
9. Storing and protecting personal information
We hold personal information electronically, mainly in cloud services provided by the suppliers listed in section 6. We take reasonable steps to protect it from misuse, interference, loss and unauthorised access, modification or disclosure. These steps include access controls, secure connections and limiting access to people who need it to do their work.
No system is completely secure. If we experience an eligible data breach, we will assess it and notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as the Notifiable Data Breaches scheme requires.
We keep personal information only for as long as we need it for the purposes in section 4 or to meet legal, tax and record-keeping obligations. When we no longer need it, we take reasonable steps to destroy it or de-identify it.
10. Accessing and correcting your personal information
You can ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete or misleading. Email us using the details in section 14. We may need to confirm your identity first.
We do not charge for making a request. If a fee applies to giving access, it will be reasonable and we will tell you first. We aim to respond within 30 days. If we cannot give you access or correct your information, we will explain why in writing and tell you how to complain.
11. Complaints
If you think we have breached the Privacy Act or this policy, please email us with the details. We will acknowledge your complaint promptly, investigate it, and aim to respond within 30 days.
If you are not satisfied with our response, you can contact the OAIC at oaic.gov.au.
12. Visitors and customers outside Australia
Where your information goes
We are based in Australia. If you are outside Australia, personal information you give us or that we collect when you use our Services will be transferred to, and handled in, Australia. Some of our service providers also store and process information outside Australia, mainly in the United States, and potentially in other countries where they or their sub-providers operate, which can include Singapore, Israel and countries in Europe. Where we disclose personal information to an overseas recipient, we take reasonable steps to make sure it handles the information consistently with the APPs, such as choosing established providers and using contracts.
Your rights under local law
Depending on where you live, you may have additional rights, such as to access, correct or delete your personal information, to receive a copy of it, or to limit certain uses. If local privacy law applies to our handling of your information, we will respond to your request under that law. Email us using the details in section 14. We may need to confirm your identity, and you may ask an authorised agent to make a request for you.
Residents of the United States
In the last 12 months we have collected the following categories of personal information, for the purposes in section 4: identifiers (such as name, email address and IP address), professional or business information (such as company and job title), internet and network activity (such as pages viewed and interactions with our website), and approximate location. We do not sell personal information for money. Some of our marketing and measurement tools, such as the LinkedIn Insight Tag, may involve disclosing information to an advertising partner in a way that some state laws describe as “sharing” or “targeted advertising”. You can opt out using the choices described in our Cookie Policy or by emailing us. We will not treat you differently for exercising your privacy rights.
13. Changes to this policy
We may update this policy from time to time. The latest version is always on our website, with the date it was last updated at the top. If we make a significant change, we will make it clear on the website.
